On 3 March 2020, training on “Copyright law and know-how protection in IT agreements – a practical approach” will be held in Warsaw.
The event will be dedicated to practical methods of copyright and know-how protection in IT agreements. Based on examples, we will explain how to word an agreement from the perspectives of both the contractor and the client to ensure the best protection of copyright and know-how in practice, what such protection involves, how to strengthen the firmness of rights, how to submit claims, and what kind of claims in respect of violation of copyrights may be submitted.
This training will be hosted by Magdalena Gąsowska-Paprota, attorney-at-law, and Joanna Stecyk, attorney-at-law.

Training course: Implementation or Audit of Compliance Systems as Securing a Company from the Risk of Criminal Liability of Collective Entities in the Light of the New Act
According to recent reports, the amendment to the Act on liability of collective entities for prohibited acts will soon be adopted. It introduces significantly broader basis for company’s liability and widens the scope of possible sanctions, hence increasing the risks of conducting business activity. In the light of the above, there is greater significance of compliance procedures applied by companies. Learning about the bill before it is adopted will allow for quicker organisational response within a company to limit the dangers to operational activities.
A training session entitled “Implementation or audit of compliance systems as securing a company from the risk of criminal liability of collective entities in the light of the new act” organised by Centrum Promocji Informatyki will be held in Warsaw on 19 February 2019.
The following matters will, among other things, be discussed during the meeting:
- key assumptions of the bill concerning the liability of collective entities for acts prohibited under the threat of penalty
- scope of liability of a collective entity – company
- discussion on the sanctions laid down by the bill

Webinar: New EBA guidelines on outsourcing versus the national approach of KNF (Polish Financial Supervision Authority) to cloud computing
We would like to invite you to a webinar prepared by the Polish Chamber of Information Technology and Telecommunications (PIIT), “New EBA guidelines on outsourcing versus the national approach of KNF to cloud computing”, which will take place in Warsaw on 19 February 2020.
During the event, a new communication being prepared by the KNF, concerning the principles of use of data processing services provided in a cloud by supervised entities. The speakers will focus on the most recent changes in KNF’s approach to cloud computing and an assessment of their impact on operation of cloud providers. In addition, the assumptions underlying KNF’s position will be compared with EU solutions, i.e. the guidelines on outsourcing prepared by the European Banking Authority, which cover, inter alia, issues related to the use by selected providers of data processing services delivered in a cloud computing model.
The webinar will be hosted by attorney-at-law Jan Byrski, PhD Habil., Professor of the Krakow University of Economics, and trainee attorney-at-law Michał Synowiec.

Webinar: Software patentability under the amended Industrial Property Law
Computer software patentability has been a controversial issue for many years, both in the daily practice of authorities and in case law. The lack of a uniform position is also evidenced by the different approaches applied by Polish authorities and courts, and the European Patent Office. We would like to invite you to the webinar “Software patentability under the amended Industrial Property Law”, which will take place on 23 January 2020.
During the event, Anna Sokołowska-Ławniczak, patent attorney, will present how the newest amendment to the Industrial Property Law may lead to a more liberalized approach to patent protection of computer software.
The event is organized by the Polish Chamber for IT and Telecommunications (PIIT).
The next edition of the “Construction contracts: investor-contractor relations in the process of implementing a construction project” workshop organised by the Puls Biznesu daily will take place on 11-12 December 2019 in Warsaw.
The purpose of the meeting is to familiarise the participants with the duties arising from construction law, including effective conclusion of contracts for construction projects, rights arising from warranty and guarantee, and ways of securing claims.

Congress: Data Protection Officers
The 24th Congress of Data Protection Officers organised by ENSI will be held on 3-5 December 2019. The title of this year’s meeting is “Knowledge. Practice. Compliance. GDPR IMPLEMENTATION AUDIT – 2019”.
Relevant issues regarding GDPR implementation and national supplementary provisions will be analysed during the event. The Congress will also allow its participants to verify whether GDPR regulations are correctly exercised in their organisational units and whether the requirements of the GDPR national supplementary provisions were appropriately implemented.

The facilitations and preferences for innovative entrepreneurs announced by the government took on such forms as for example the IP Box, a preferential 5% income tax rate from qualifying intellectual property rights. This July the Minister of Finance issued explanations concerning the application of the deduction as a response to the entrepreneurs’ questions. Unfortunately, their content did not remove the doubts arising from the regulations, and even deepened some of the concerns of particular significance for the IT industry.
A webinar entitled “IP Box – doubts regarding explanations” organised by the Polish Chamber for IT and Telecommunications will take place on 28 November.

Academic conference of the Polish Patent Office: Intellectual Property Yesterday and Today. 100 Years of Poland’s Membership in the Paris Convention
An academic conference of the Polish Patent Office will be held in the Warsaw Stock Exchange building on 28–29 November 2019. It is entitled “Intellectual Property Yesterday and Today. 100 Years of Poland’s Membership in the Paris Convention”.
On the first day of the event, attorney-at-law Paweł Podrecki, PhD Habil., Professor of the Institute of Law Studies of the Polish Academy of Sciences, will moderate a Patent Law panel. The following issues will be addressed:
- Patent package (current meaning)
- Accumulation of protection of intellectual property in the life sciences sector
- Patent infringement in the light of private international law
- Patent in bankruptcy or winding up proceedings
- New exception for decompilation and interoperability in patent law
- Quo vadis bio?
Tomasz Targosz, PhD, attorney-at-law, will participate in a panel on Infringement vs. Use – Copyright Law Against the Background of Industrial Property Law on the second day of the Conference. The matters to be discussed include:
